Acceptance of Terms
By accessing and using IsMy.Date, you agree to be bound by these terms and conditions in their entirety. If you do not agree with any part of these terms, you must not use our services. Continued use of the service constitutes acceptance of any modifications to these terms.
Use of Service and Public Content
You may use our service to create and manage digital invitations. You may NOT use the service for illegal, fraudulent activities, violations of third-party rights, or content that is defamatory, obscene, or offensive. IMPORTANT: Created invitations are public and accessible via URL. Do not include sensitive, confidential information, banking data, passwords, personal identification numbers, or any information that could compromise your security or that of your guests.
Prohibited Content
It is strictly prohibited to use our service for: illegal content, spam, phishing, malware, harassment, discrimination, copyright infringement, or any activity that may harm other users or IsMy.Date. We reserve the right to remove any content that violates these terms without prior notice.
User Account and Security
You are solely responsible for maintaining the confidentiality of your account and password. You must notify us immediately of any unauthorized use or suspicion of unauthorized access. IsMy.Date, its owners, partners and participants in the project are not responsible for losses resulting from unauthorized use of your account due to your negligence in protecting your credentials.
Payments and Refunds
Payments are processed securely through third-party payment providers. Prices may change, but will not affect active subscriptions during the contracted period. All payments are final and non-refundable, except when required by law. We do not offer refunds for services already used.
Delivery and timelines
After payment, delivery of the configured invitation is made within 24 business hours, provided the customer has supplied the required information (text, images, event details) in a timely and complete manner. Delays due to incomplete, late, or additional customization requests are not the responsibility of IsMy.Date or its owners, partners or participants in the project.
Price additions
The price shown corresponds to standard customization of the chosen template. Additional charges may apply if the customer requests significant extra customization or a fully custom invitation. In such cases, IsMy.Date will inform the customer of the cost before any additional charge. IsMy.Date, its owners, partners and participants shall not be liable for price discrepancies except for errors expressly acknowledged in writing.
Account access after order
After placing an order, the customer is provided with an account to manage their invitation and view associated information (confirmations, messages). The customer is responsible for the use of their credentials and for keeping them confidential.
Rights to music, songs and images
The customer declares that they have the necessary rights to publish any music, songs or images they request to include in their invitation, and accepts responsibility for the final content of the invitation (text, images, music, design and any other published element). IsMy.Date, its owners, partners and participants in the project do not verify ownership of such content and are exempt from any liability to third parties for use of music, images or other protected material. Data and images provided by the customer are the customer's sole responsibility.
Intellectual Property
All site content, including templates, designs, code, logos, text, and graphics, is the property of IsMy.Date or its licensors and is protected by intellectual property laws, copyrights, and trademarks. You may not copy, modify, distribute, sell, or create derivative works without express written authorization.
User Content
By uploading content to our service, you grant IsMy.Date a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely to provide and improve our services. You retain all rights to your content.
Security, Hacking, and Limitation of Liability
Although we implement reasonable security measures, no system on the internet is 100% secure. IsMy.Date, as well as its owners, partners, participants in the project and any natural or legal person related thereto, are NOT responsible for: (1) hacking, cyber attacks, security breaches, or unauthorized access to our systems or your account; (2) loss, corruption, or theft of data; (3) service interruptions, technical failures, system errors, or connectivity issues; (4) any damage resulting from malware, viruses, or malicious code; (5) unauthorized access to information you have made public through shared URLs. The user acknowledges and accepts that they use the service at their own risk and that IsMy.Date does not guarantee absolute security.
Disclaimers and Warranties
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. IsMy.Date, its owners, partners and participants in the project do not guarantee that the service will be uninterrupted, error-free, secure, or that it will meet your specific needs. We do not guarantee the accuracy, completeness, or usefulness of any information on the service.
Release of liability
By using the service, you release and hold harmless IsMy.Date and any of its owners, partners, participants in the project, legal representatives, employees, collaborators and any natural or legal person related thereto, to the maximum extent permitted by applicable law, from any damage, claim or loss that may arise from the use of the service or the inability to use it.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IsMy.Date, AS WELL AS ITS OWNERS, PARTNERS, PARTICIPANTS IN THE PROJECT AND ANY NATURAL OR LEGAL PERSON RELATED THERETO, SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: data loss, profit loss, business interruption, or any other damage resulting from the use or inability to use our services, even if we have been advised of the possibility of such damages. Total liability shall not exceed the amount you have paid for our services in the last 12 months.
Indemnification
You agree to indemnify, defend, and hold harmless IsMy.Date, its affiliates, directors, employees, agents, owners, partners, participants in the project and any natural or legal person related thereto from any claim, demand, loss, liability, and expense (including legal fees) arising from: (1) your use of the service; (2) your violation of these terms; (3) your violation of any third-party rights; or (4) any content you post.
Termination
We reserve the right to suspend or terminate your access to the service at any time, with or without cause, with or without prior notice, for any reason, including violation of these terms. You may terminate your account at any time by contacting us.
Removal of invitation after the event
The digital invitation will remain published and accessible for as long as IsMy.Date determines. After at least one (1) month has passed from the date of the event for which the invitation was created, IsMy.Date may remove the invitation (content, link and associated data) when required for operational, capacity or service policy reasons. The customer accepts this possibility and shall have no claim arising from the removal of the invitation once this period has elapsed.
Governing Law
These terms are governed by applicable laws. Any dispute will be resolved in competent courts. If any provision of these terms is invalid, the remaining provisions will remain in full force.
